This Acceptable Use Policy (“AUP”) governs your use of the SonarSend platform and services (the “Service”) and is part of, and incorporated by reference into, the SonarSend Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. “We,” “us,” and “SonarSend” mean Framework Learning, LLC, which operates SonarSend; “you” and “your” mean the customer, its users, and anyone accessing the Service through your account.
Our stance#
SonarSend is built for professionals who run their own email programs. We do not require double opt-in, we do not routinely audit or pre-screen your imports, and we do not gate your campaigns behind manual review. You know your audience; we trust you to run your program.
The rules below exist for two narrow reasons: to stop genuine abuse (illegal, fraudulent, or harmful activity), and to protect the shared infrastructure that every SonarSend customer’s deliverability depends on — our tracking servers, network addresses, link-handling, and edge systems. Because you send through your own sending provider (Amazon SES, SendGrid, Mailgun, or another), that provider independently determines what recipient sources, consent practices, industries, content, and sending methods it permits through its services. It also governs your sending reputation and enforces sending-hygiene standards, such as bounce and complaint limits, on your provider account. We do not duplicate those provider-specific rules. You must comply with both your provider’s requirements and this AUP, and you remain responsible for complying with applicable law.
1. Who this applies to#
This AUP applies to all customers, users, accounts, API clients, and anyone who accesses or uses the Service, and to all content, campaigns, contacts, and data you process through the Service.
2. Your responsibilities as a sender#
You are solely responsible for the messages you send, the recipients you send them to, and your compliance with law. Specifically, you agree that:
- Lawful basis. You represent and warrant that you have a lawful basis to contact each recipient you email through the Service. You are responsible for determining and maintaining that basis.
- Compliance with law. You will comply with all applicable laws and regulations governing your messages, including without limitation the U.S. CAN-SPAM Act, the EU/UK GDPR, Canada’s CASL, the ePrivacy rules, and any applicable marketing, consumer-protection, and data-protection laws. As between you and SonarSend, you are the controller of, and responsible party for, your contact data.
- Unsubscribe and opt-out. Every commercial or marketing message you send will include a functional unsubscribe mechanism, and you will honor unsubscribe and opt-out requests promptly.
- Accurate identification. Your messages will accurately identify you as the sender and will not use false, deceptive, or misleading header information, “from” names, or subject lines.
- Your Sending Provider and its terms. You are responsible for your Sending Provider account and for the security of the credentials you connect to the Service. Your Sending Provider independently determines which recipient sources, consent practices, industries, content, and sending methods it permits. You must comply with all applicable terms, policies, restrictions, and instructions of your Sending Provider. Activity prohibited by your Sending Provider is also prohibited through SonarSend, even if it is otherwise lawful or is not expressly identified in this AUP. Compliance with your Sending Provider’s requirements does not necessarily establish compliance with applicable law.
- Website tracking and forms. If you install SonarSend’s website tracking on your sites or collect information through SonarSend forms, you will provide the privacy notices and obtain the consents (including for cookies and similar technologies) that applicable law requires, and you will not use them to collect information you are not permitted to collect.
What we do not require of you. For the avoidance of doubt, SonarSend does not impose a separate opt-in model, routinely audit how you sourced your contacts, or review or approve campaigns before you send them. These responsibilities are yours as a professional sender. We may nevertheless request information reasonably necessary to investigate a credible complaint, suspected legal violation, Sending Provider action, or threat to the Service or shared infrastructure.
3. Prohibited content and uses (hard prohibitions)#
You may not use the Service to create, send, host, distribute, or facilitate any of the following. Violations may result in immediate suspension or termination without notice and, where applicable, reporting to authorities:
- Illegal activity. Any content, product, service, or activity that is illegal under applicable law, or that promotes, facilitates, or provides instructions for illegal activity.
- Exploitation of minors. Any content that sexually exploits, abuses, or endangers minors (including CSAM). We report such content to the appropriate authorities and organizations as required by law.
- Terrorism, extremism, and sanctions. Content that promotes, supports, or is produced on behalf of terrorist or violent-extremist organizations; and any use by, for, or on behalf of individuals or entities subject to applicable sanctions (including sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC), the United Nations, the European Union, or the United Kingdom).
- Human trafficking and exploitation. Content facilitating human trafficking, forced labor, or sexual exploitation.
- Fraud and deception. Phishing, credential harvesting, spoofing or impersonation of any person or entity, malware, spyware, ransomware, or other malicious code; fraudulent, deceptive, or counterfeit goods, services, or schemes.
- List brokering and list abuse. Using the Service to sell, rent, broker, trade, or distribute email lists or contact data; or to operate a list-verification, list-cleaning, or address-validation service for others, or to validate or “wash” addresses you do not intend to email. This restriction does not limit the list-hygiene features built into the Service, and applies regardless of how you sourced your own list for your own sending.
- Adult content on shared infrastructure. Distribution of pornographic or sexually explicit content, or escort/adult-services content, through SonarSend’s tracking, link-handling, or hosted infrastructure.
- Threats and harm. Content that threatens or incites violence or physical harm against any person or group.
- Platform-threatening activity. Any content or use that, based on your actual activity, we reasonably believe threatens the integrity, security, reputation, or availability of SonarSend’s shared infrastructure, or SonarSend’s standing with sending providers.
4. Industries and categories#
SonarSend does not categorically exclude a customer solely because of its lawful industry. Use of the Service remains subject to this AUP and to your Sending Provider’s requirements, which may prohibit or restrict particular industries, content, recipient sources, consent practices, or sending methods. We do not require pre-approval or vet you merely based on what you sell. Any action we take under Section 6 is based on conduct or objective risk indicators relating to your account or activity, not solely on your industry.
5. Platform integrity#
You may not, and may not permit others to:
- Interfere with, disable, circumvent, or attempt to defeat the Service’s tracking, rate-limiting, or abuse-detection mechanisms;
- Create multiple accounts, or otherwise structure your activity (“snowshoeing”), to evade limits, suspensions, or monitoring;
- Access or attempt to access any account, data, or system you are not authorized to access, or probe or test the vulnerability of the Service without authorization;
- Resell, sublicense, or provide the Service’s sending or tracking capabilities to unrelated third parties without our prior written consent; or
- Use the Service to send through any sending provider in violation of that provider’s terms.
6. Shared-infrastructure protection#
Your tracking hostname is your own, but the tracking servers, network addresses, link-handling, edge systems, and related infrastructure behind it are shared across customers, and abuse or reputational harm caused by one customer can affect deliverability for others. To protect that shared infrastructure and our standing with sending providers, we may take the graduated actions below. We will generally aim to apply the least disruptive effective measure first.
Graduated enforcement. Depending on the nature and severity of the issue, our responses may include, in escalating order:
- Alerting you to a complaint, bounce, blocklisting, or reputation signal;
- Pausing scheduled or in-progress sending (reversible);
- Rate-limiting or throttling your sending;
- Suspending your account’s access to the Service; and
- Terminating your account.
Notice and opportunity to cure. For reputation, deliverability, complaint, and similar signals, we will generally aim to notify you and work with you to resolve the issue before suspending your account — except where immediate action is necessary to protect the platform or other customers, to comply with law, or to address content or conduct prohibited under Section 3, which may result in immediate suspension or termination without notice.
Behavior- and risk-based, not category-based. Our monitoring and enforcement may consider observed activity, credible complaints or threat intelligence, complaints and bounces (including blocklist-related bounces), escalations from your Sending Provider or blocklist operators, abuse reports, reasonably anticipated harm, and other objective risk indicators, in each case relating to your account or activity. The industry or category you operate in does not by itself trigger action.
Reasonable-belief standard. We may act under this Section where we reasonably believe your activity violates this AUP or threatens the shared infrastructure or our standing with sending providers.
7. Monitoring and inspection#
We may, but are not obligated to, review account activity, metadata, and content to investigate suspected abuse, respond to complaints, comply with law, and protect the Service and its customers. This is not routine, pre-send review of your campaigns, which we do not perform. We are not responsible for, and do not endorse, content you send.
8. Reporting and cooperation#
We may report violations of Section 3 to law enforcement, sending providers, blocklist operators, and other appropriate parties, and we may cooperate with lawful investigations. You will reasonably cooperate with us in investigating suspected abuse originating from your account.

10. Changes to this policy#
We may update this AUP from time to time. Material changes will be communicated as provided in the Terms of Service. Your continued use of the Service after an update takes effect constitutes acceptance of the updated AUP.
